1. General Public Comment
(The public is now welcome to address the Commission regarding items that do not appear on tonight’s agenda but that are within the subject matter jurisdiction of the Commission. Speakers shall address their remarks to the Commission as a whole and not to individual Commissioners or Department or OCC personnel. Under Police Commission Rules of Order, during public comment, neither Police or OCC personnel, nor Commissioners are required to respond to questions presented by the public but, may provide a brief response. Individual Commissioners and Police and OCC personnel should refrain, however, from entering into any debates or discussion with speakers during public comment. Please limit your comments to three (3) minutes.)

PERSONNEL EXCEPTION: Assignment of Disciplinary Charges filed in Case No. IVF C11-024 to a Commissioner for taking of evidence on a date to be determined by the Commissioner (ACTION ITEM)


b. Pursuant to Government Code Section 54957(b)(1) and San Francisco Administrative Code Section 67.10(b) and Penal Code Section 832.7:
PERSONNEL EXCEPTION: Discussion and possible action to issue Police Commission subpoenas in the matter of Case No. KMO C10-032 (ACTION ITEM)

c. Pursuant to Government Code Section 54957(b)(1) and San Francisco Administrative Code Section 67.10(b) and Penal Code Section 832.7:
PERSONNEL EXCEPTION: Discussion and possible action to accept or reject stipulated agreement filed in disciplinary case no. JWA C10-042(ACTION ITEM)

d. Pursuant to Government Code Section 54957(b)(1) and San Francisco Administrative Code Section 67.10(b) and Penal Code Section 832.7:
PERSONNEL EXCEPTION: Discussion and possible to sustain or not sustain disciplinary charges filed in case no. IVF C09-143, and if sustained, decide penalty (ACTION ITEM)

e. Pursuant to Government Code Section 54957(b)(1) and San Francisco Administrative Code Section 67.10(b) and Penal Code Section 832.7:
PERSONNEL EXCEPTION: Status and calendaring of pending disciplinary cases

9. Vote to elect whether to disclose any or all discussion on Item 8 held in closed session (San Francisco Administrative Code Section 67.12(a)) (ACTION ITEM)

10. Discussion and possible action to grant or deny Motions for Dismissal of Disciplinary Charges filed against Officer Wendy Hurley, Case No. JCT C06-187; decision to sustain or not sustain disciplinary charges, if necessary; decision to decide penalty, if necessary (ACTION ITEM)

The Commission may decide to consider Item 10, in whole or in part, in Closed Session pursuant to Government Code section 54957(b)(1) and S.F. Administrative Code Section 67.10(b).

a. Public Comment on all matters pertaining to Item 10, including public comment on whether the Commission should hold Item 10 in closed session, in whole or in part
b. Vote on closed session (ACTION)
i. Vote whether to hold argument by the parties in closed session
ii. Vote whether to hold Commission deliberations in closed session
c. Hearing and deliberation on Item 10, in open or closed session per the Commission’s vote (DISCUSSION & POSSIBLE ACTION)
d. If closed session is held, reconvene in open session:
i. Report any action taken in closed session as specified in Government Code section 59457.1 and S.F. Administrative Code section 67.12(b).
ii. Vote to elect to disclose any or all discussions held in closed session pursuant to S.F. Administrative Code 67.12(a) (ACTION)

11. Discussion and possible action to grant or deny Motions for Dismissal of Disciplinary Charges filed against Officer James Lewis, Case No. JCT C06-186; decision to sustain or not sustain disciplinary charges, if necessary; decision to decide penalty, if necessary (ACTION ITEM)

The Commission may decide to consider Item 11, in whole or in part, in Closed Session pursuant to Government Code section 54957(b)(1) and S.F. Administrative Code Section 67.10(b).

b. Vote on closed session (ACTION)
